On January 22, 2010, a pre-hearing conference was held at the request of Morneau Sobeco the Implementing Administrator, in respect of two distinct categories of issues each of which will be subject to a separate hearing process.  The categories of issues are:

(1) Certain issues in respect of the wind up of the Plan raised by the Implementing Administrator.

At a hearing on March 25, 2010, the Tribunal will determine whether or not it should grant the following relief:

  •  the Implementing Administrator requests that the Tribunal confirm that the Plan, as modified by the Original Order (and in particular paragraphs 5 and 17 thereof), requires the Implementing Administrator to provide excess contribution benefits to the deferred vested members; and
  •  The Implementing Administrator requests that the Tribunal issue an order confirming that non-commutable deferred pensions with no option for portability be purchased for members who are unlocated at the date of Settlement and members that do not respond to communications from the Implementing Administrator.
            

(2) Expedited adjudication of individual entitlement issues raised by 5 Claimants pursuant to paragraphs 7 and 22 of the Tribunal’s Original Order.

            

A hearing is scheduled for April 14-16, 2010 to deal with the individual entitlement issues.
