On March 8, 2007, The Canada Life Assurance Company (the “Applicant”) requested a hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated January 30, 2007, proposing to make an order under section 69(1) (d) and section 69(1) (e) of the Act that The Canada Life Canadian Employees Pension Plan, Registration Number 0354563, (the "Plan") be partially wound up in relation to those members and former members of the Plan who ceased to be employed by Adason Properties Limited (“Adason”) during the period November 1, 1999 to February 28, 2001.

Adason is a wholly-owned subsidiary of the Applicant that provides management services in respect of the Applicant's portfolio of real estate assets. Due to a decline in the number of real estate assets in the Applicant's investment portfolio that required management services, a total of 35 out of 58 employees of Adason lost their employment during the period November 1, 1999 to February 28, 2001, some as the result of the discontinuance of management services at three locations and others as a result of a reduction in the management services provided at two other locations.

A pre-hearing conference is scheduled for June 18, 2007.

At the pre-hearing conference on June 18, 2007, full party status was granted to Adason Properties Limited Members’ Pension Committee.  The hearing is scheduled for December 17 – 20, 2007.

On October 16, 2007, the pre-hearing conference resumed at which time the dates for the hearing were rescheduled to February 18–20 and 22, 2008 to accommodate dates for a motion hearing and settlement conference.  The disclosure motion is scheduled for December 17, 2007 and the settlement conference is scheduled for December 20, 2007.

On November 19, 2007 additional dates were scheduled for the hearing in this matter.  The hearing will commence on February 19 and continue on February 20, 22, March 3 and 4, 2008.

On December 3, 2007, the parties advised the Tribunal that they are engaged in settlement discussions and requested an adjournment of the dates set for the motion and hearing.  The Tribunal granted the adjournment request and rescheduled the motion hearing for March 3, 2008, and the hearing for June 2,3, 5 and 6, 2008, in the event the matter does not settle.  The Tribunal also cancelled the settlement conference scheduled for December 20, 2007.

On February 14, 2008, the parties requested a sine die adjournment of the motion hearing and the hearing dates on the basis that they continue to be engaged in complex settlement discussions.  The Tribunal granted an adjournment of the matter to November 24, 26, 27 and 28, 2008.

On June 18, 2008, the parties requested a further adjournment of the matter as they do not anticipate having concluded their settlement discussions by the November hearing dates.  The Tribunal granted the adjournment and rescheduled the hearing to March 3 – 6, 2009.

On November 6, 2008, the parties requested a further adjournment of the March 2009 hearing dates as they continue to be engaged in settlement discussions but do not expect to have concluded those discussions by that time.   The Tribunal granted the adjournment and scheduled a continuation of the pre-hearing conference for March 3, 2009 in order for the parties to update the Tribunal on the status of their settlement discussions.
