On September 10, 2008, the Communications, Energy and Paperworkers Union of Canada, Local 555, (the “Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated August 20, 2008, to refuse to make an Order under section 87 of the PBA that Parmalat Canada Inc. is responsible for the payment of the investment management fees and management expense ratio fees (“IMF/MER fees”) charged in connection with variable investments in respect of the Parmalat Canada Pension Plan for Hourly Employees - Belleville, Registration Number 308353.

A pre-hearing conference is being scheduled.

On October 3, 2008, an application for party status was filed by Parmalat Canada Inc.  A pre-hearing conference is scheduled for November 14, 2008.

Updated to October 24, 2008

At a pre-hearing conference on November 14, 2008, full party status was granted to Parmalat Canada Inc.  The parties indicated their willingness to participate in a settlement conference.  The settlement conference is scheduled for February 13, 2009. Dates were scheduled for the evidence portion of the hearing on April 14-17, 2009 and April 30, 2009 for oral argument, in the event the matter does not settle.

On March 19, 2009, the Applicant withdrew its request for hearing as the matter was settled.  The hearing dates were cancelled and the Tribunal closed its file.
