On September 16, 2008, the Ontario Teachers’ Pension Plan Board (the "Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated August 18, 2008, to make an Order in respect of the Ontario Teachers’ Pension Plan, Registration Number 0345785, (the "Plan”)
under sections 63(3) and 87(2)(a) of the PBA, that contributions made by the late Audrey Horne be refunded with interest at the rate used to calculate interest on contributions of members and former members
under the Plan, from the date Mrs. Horne’s membership in the Plan terminated to the beginning of the month of payment.
Updated to October 24, 2008 At the pre-hearing conference on December 1, 2008, hearing dates were scheduled for May 25 – 26, 2009. Updated to December 18, 2008 On March 17, 2009, the parties requested a suspension of the filing deadlines set in this matter as they are engaged in settlement discussions. The Tribunal granted the request and adjourned the hearing dates. A pre-hearing conference is scheduled for April 14, 2009 at which time the parties will update the Tribunal on whether a settlement has been reached. Updated to April 9, 2009 At the pre-hearing conference on April 14, 2009, the parties advised the Tribunal that they have reached a settlement and minutes of settlement are being drafted. On May 12, 2009 an application for party status was filed by Arthur Horne. The pre-hearing conference is scheduled to resume on May 28, 2009. Updated to May 21, 2009 On May 13, 2009 the Applicant withdrew its request for hearing. At the pre-hearing conference on May 28, 2009 the Tribunal dismissed Mr. Horne’s application for party status. As the request for hearing was withdrawn the Tribunal closed its file. |
