On October 9, 2008, York University Faculty Association (the “Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated September 11, 2008, to make an Order in respect of the York University Plan, Registration Number 0329763 (the “Plan”), to require the administrator of the Plan, when calculating the adjustment to be applied to pensions
in the current year, to cease taking into account any negative adjustment in investment returns which are below the level indentified in the Plan in previous years, and to refuse to a make an Order to require the administrator to rectify the pensions of former members whose annual adjustment has taken
into account any negative adjustment for such performance of the investment of the Trust Fund in previous years when calculating the adjustment in the current year, under section 87 of the PBA. Updated to October 24, 2008 On October 27, 2008, York University filed an application for party status. A pre-hearing conference is scheduled for February 2, 2009. Updated to November 24, 2008 At a pre-hearing conference on February 2, 2009, full party status was granted to York University. A further pre-hearing conference is scheduled for May 15, 2009. Updated to February 13, 2009 On April 30, 2009, the Canadian Union of Public Employees Local 3903 (“CUPE Local 3903”) filed an application for party status.
