On October 8, 2008, Susan McGrath (the "Applicant”), filed a notice of appeal of the Notice of Registration of Amendment, dated September 11, 2008, of the Pension Officer by delegated authority from the Superintendent of Financial Services, for confirmation of the registration of By-Law No. 7 effective November 29, 2007 and January 1, 2008, pursuant to section 17 of the PBA.  The amendment relates to the inflation protection methodology under the Plan. The OMERS Administration Corporation requested the Superintendent re-issue the Notice of Registration of Amendment for By-Law No. 7 due to a typographical omission.

A pre-hearing conference is being scheduled.

On January 13, 2009, the Tribunal granted full party status to OMERS Administration Corporation, and to OMERS Sponsors Corporation.  A further pre-hearing conference is scheduled for March 4, 2009.

At a continuation of the pre-hearing conference on March 4, 2009 a date was scheduled for a motion for disclosure brought by the Applicant.  The motion is scheduled for May 4, 2009 and a further pre-hearing conference is scheduled for June 8, 2009.

At a continuation of the pre-hearing conference on March 31, 2009, the date for the disclosure motion was rescheduled to June 9, 2009, and the pre-hearing conference was rescheduled to June 15, 2009.

On October 2, 2009, the Applicant filed a request for the hearing to be held in writing.  The Tribunal will consider the submissions of all the parties on this request at a pre-hearing conference on December 10, 2009.  On November 18, 2009 an application for party status was filed by Gloria Motta.

During the month of December, applications for party status were filed by the Police Pensioners Association of Ontario, the International Alliance Theatrical Stage Employees Local 58, Mary-Ann Zak and Randel Davy.  At a continuation of the pre-hearing conference on December 10, 2009, the Tribunal granted limited party status to the Police Pensioners Association of Ontario and to the International Alliance Theatrical Stage Employees Local 58 and dismissed the applications filed by Gloria Motta, Mary-Ann Zak and Randel Davy.  The Applicant’s request for the hearing to be held in writing was denied by the Tribunal.  The hearing will commence as scheduled on January 18, 2010.

On January 18, 2010, the evidentiary portion of the hearing concluded.   The legal argument phase of the hearing is scheduled to commence on February 8, 2010.
