On February 6, 2009, CAW-Canada Local 2007 (the “Applicant”), filed a request for hearing regarding the Notice of Proposal of the Deputy Superintendent, Pensions, dated January 13, 2009, to refuse to make an Order in respect of the Woodbine Entertainment Group Mutuel Employees’ Pension Plan, Registration Number 0430165 under section 87 of the PBA, requiring the Administrator of the Plan to accept all Non-Seniority List mutuel employees of Woodbine Entertainment Group who meet the minimum service requirements under the Act as members of the Plan retroactive to 1988.

A pre-hearing conference is being scheduled.

At a pre-hearing conference on April 20, 2009, full party status was granted to Woodbine Entertainment Group.  The parties expressed their interest in participating in a settlement conference
which is scheduled on June 12, 2009.  A further pre-hearing conference is scheduled for June 29, 2009 to update the Tribunal on the progress of any settlement and whether it will be necessary to schedule a hearing.
